Quick Summary

Here is a plain-English overview of our key privacy practices. The sections that follow provide full details.

What we collect Account and profile data, tournament and gameplay activity, wallet and payment information, device and technical data, chat, discussion, stream, and moderation content, and, through our payment processor, identity verification data for cash-outs.
Why we collect it To operate the Platform and its tournament features, maintain your wallet and process payments, keep the Platform secure, moderate conduct, and communicate with you.
Who we share it with Our hosting, payment, analytics, and support providers. We do not sell your personal data.
How long we keep it Account data while active and for a reasonable period after closure. Wallet and payment records as long as required by law. Tournament results are kept permanently, but are de-identified if you delete your account.
Your rights Depending on where you live, you may have the right to access, correct, delete, or port your data and to opt out of certain uses.
Children’s privacy The Platform is not directed at children under 13. We do not knowingly collect personal data from children under 13. Only users who have reached the age of majority in their state of residence may create accounts. Teens may join the waitlist (13 and older in the US, 16 and older elsewhere).

What We Collect

Data You Give Us Directly

When you create an account, participate in tournaments, or contact us, you provide us with:

  • Account registration data: username, email address, date of birth, and the basic profile information (such as your name, email address, and profile picture) that a third-party login service shares with us when you use it to sign in.
  • Profile data: display name, profile picture or avatar, and any other information you add to your profile.
  • Payment and wallet data: when you purchase Tickets or redeem Points, our payment processors collect your payment card or account details. We receive only a transaction confirmation and the last four digits of your payment method -- we do not store full payment card data.
  • Identity verification and tax data: to cash out Points, you may need to verify your identity and provide bank account and tax information (such as an IRS Form W-9). Our third-party payment processor collects this information directly, under its own privacy policy. Some identity checks compare a photo of your face with your identification document, which uses biometric data (facial geometry). Before any such check, you will be told what is collected and why, and asked for your written consent. We receive only what we need, such as whether verification succeeded and the tax information required to report payouts.
  • Support and feedback: messages, emails, and other communications you send us through support channels or feedback forms.
  • Waitlist and tester applications: when you join the waitlist or apply to help test the Platform, we collect your email address, your country (and US state, if applicable), and your date of birth or confirmation of your age. Tester applications also ask a few questions about your gaming and tournament habits.

Data We Collect Automatically

When you use the Platform, we collect certain data automatically:

  • Tournament and Platform activity: your tournament registrations, scores submitted, leaderboard positions, flags filed or received, hosting activity, and wallet transaction history.
  • Device and technical data: IP address and approximate location derived from it, device type and identifiers, operating system, browser type and version, and performance data (crashes, errors, load times).
  • Usage data: features accessed, pages visited, time spent on the Platform, login times and frequency, and navigation patterns.

Communications and Stream Content

When you use Platform communications features or host or participate in tournament streams, or use the moderation system, we may collect:

  • Chat and discussion messages: messages sent through in-Platform chat and discussion features, such as questions to hosts, team-finding posts, and support requests. We retain and review this content to enforce our Terms of Use, Tournament Official Rules, and Moderation and Penalty Process.
  • Stream recordings: where a tournament requires streaming, you are responsible for your stream through a third-party platform (e.g., YouTube). Score submissions must include a recording link. We access and review recordings during the score validation process and may retain a reference to the recording for the duration of the dispute and retention period.
  • Score submission content: scores submitted, supporting recording links, timestamps, and any flags or dispute records associated with your submission.
  • Moderation content: reports (flags) you submit or that are submitted about you, the evidence and discussion attached to them, votes, disputes, escalations, appeals, and outcomes, including warnings, private notes, and penalties on your account.

Cookies and Similar Technologies

Our website uses cookies and similar tracking tools. Cookie categories we use:

  • Strictly necessary: required for the Platform to function (e.g., login sessions). These cannot be disabled.
  • Functional: remember your preferences (e.g., language, region).
  • Analytics: help us understand how visitors use the Platform, using Google Analytics. Google’s use of this data is described at policies.google.com/technologies/partner-sites, and you can opt out using the Google Analytics Opt-out Browser Add-on, available at https://tools.google.com/dlpage/gaoptout.
  • Third-party embeds: when a page includes an embedded video player, such as from YouTube, Twitch, or Vimeo, that provider may set its own cookies, including tracking cookies, and collect information about your device and viewing under its own privacy policy.

You can manage cookie preferences through your browser settings, or by using the Google Analytics opt-out described above.

Who We Share Your Data With

Zovian does not sell your personal data to third parties. We share data only as described below.

Service Providers

We share data with companies that help us deliver the Platform, including:

  • Cloud hosting and infrastructure providers for hosting Platform servers and storing data.
  • Third party payment processors to process Ticket purchases, Points redemptions, and prize payouts, and to verify identity and collect tax information for payouts. Payment processors act as independent data controllers for payment transactions.
  • Analytics providers to help us analyze Platform usage and performance.
  • Player support providers to manage support tickets and communications.
  • Email and communications providers to send account and marketing emails.

We require our service providers to use your data only to provide services to us, except where this Policy says a provider uses data under its own privacy policy, such as our payment processors.

Tournament Hosts and Moderators

Tournament hosts and moderators can see participant information necessary to administer their tournaments, including your username, submitted scores, recording links, and flag history within that tournament. Hosts and moderators are not authorized to use this information for any purpose other than administering the tournament in accordance with the Tournament Official Rules. Moderators, including Zovian Moderators, may be other users rather than Zovian employees. Moderators can see the flags they review, the evidence and discussion attached to them, and relevant moderation history, and may use that information only to carry out their moderation duties.

Other Users

When you participate in tournaments, certain information is visible to other users:

  • your username and profile picture;
  • your leaderboard position and score within a tournament; and
  • content you post in public chat and other channels.

Stream recordings you submit as part of score validation are accessible to other registered users during the validation period.

Flags are open for community review. Registered users can see an open flag, the evidence and discussion attached to it, and public outcomes, such as public warnings. Private warnings and private notes are not shown publicly, but reviewers may see them. If a similar report is made about you later, they may become public.

We may disclose your data if we believe in good faith that disclosure is necessary to:

  • comply with a legal obligation or respond to a valid government or law enforcement request;
  • enforce our Terms of Use, Tournament Official Rules, or Moderation and Penalty Process; or
  • protect the rights, property, or safety of Zovian, our users, or others.

Business Transfers

If Zovian is involved in a merger, acquisition, or sale of all or a portion of its assets, your data may be transferred as part of that transaction. We will notify you before your data becomes subject to a materially different privacy policy.

Users Outside the United States

Accounts and tournaments are available only to US residents. Zovian is based in the United States and processes data in the United States. Our public pages can be viewed from anywhere. If you visit them from outside the United States, your information will be transferred to and processed in the United States, where data protection laws may differ from those in your country. People outside the United States may join our waitlist, as described in “Waitlist and Tester Applications.”

Wallet and Financial Data

Because Zovian operates a wallet with real-money value potential, we treat financial data with heightened care:

  • We do not store full payment card numbers. Card processing is handled entirely by our third-party payment processors.
  • Wallet balances, Ticket purchase history, Points transaction history, and redemption records are retained for the period required by applicable financial and tax regulations.
  • For cash-outs, applicable law (including anti-money-laundering, know-your-customer, and tax laws) may require identity verification and tax information. Our payment processor collects and verifies this information. If a check uses biometric data, that data is kept only until the verification is complete, and in no case longer than 3 years after your last interaction with the Platform, and is then permanently destroyed. We use any verification information we receive solely for compliance purposes and keep it only as long as required by law.
  • We may report prize redemptions and payouts to tax authorities as required by law, including issuing IRS Form 1099s for qualifying amounts.

Score Validation and Fraud Detection

We may use automated tools to assist in score validation, report triage, and fraud detection on the Platform. These systems may flag potential issues for human review by tournament hosts, moderators, or Zovian staff. No automated decision that has a significant legal or similarly significant effect on you is made without human oversight.

Waitlist and Tester Applications

We use waitlist and tester application information only to manage the waitlist and the testing program, to tell you when you can join or test the Platform, and to plan our expansion. Joining the waitlist does not create an account. We keep this information until you create an account, ask us to delete it, or we end the waitlist or testing program. You can ask us to remove you and delete your information at any time by emailing contact@zovian.com or by using the unsubscribe link in our emails.

Teens. US residents who are 13 or older may join the waitlist before they reach the age of majority. We do not accept sign-ups from anyone under 13, and if our age check shows that someone is under 13, we do not keep their information. We use a teen’s information only to manage the waitlist and to tell them when the Platform becomes available to them. We never sell it or use it for targeted advertising. A parent or guardian may ask us to delete a teen’s information by emailing contact@zovian.com.

Outside the United States. People outside the United States who are 16 or older may join the waitlist, so that we can tell them if the Platform becomes available in their country. With their consent, we collect only their email address and country, and we use them only for that purpose. They may ask for a copy of their information, withdraw their consent, or have their information deleted at any time by emailing contact@zovian.com. Their information is processed in the United States.

How Long We Keep Your Data

We keep your data only for as long as necessary for the purposes described in this Policy or as required by law.

Some records stay on the Platform permanently, because they are part of each tournament’s history. These include leaderboards, placements, scores, and prize payouts. If you delete your account, we will de-identify your tournament records, so that they are no longer linked to your username, profile, or account. The results themselves will remain visible, so that other users can still see that a participant placed and received a payout. We will not attempt to re-identify de-identified data.

We keep moderation and enforcement records, such as flags, penalties, and suspension or ban records, for as long as reasonably necessary to protect the integrity of the Platform, for example to prevent a banned user from opening a new account.

We may retain some data beyond the periods described above if necessary to resolve open disputes, enforce our agreements, or comply with legal or regulatory requirements. After the applicable retention period, we will delete or de-identify your data within a reasonable time.

Data Security

We use reasonable industry-standard technical and organizational measures to protect your data from unauthorized access, loss, or misuse, including:

  • encryption at rest and in transit;
  • role-based access controls;
  • regular security audits and backups; and
  • limited access on a need-to-know basis.

If we become aware of a data breach that affects your personal data, we will notify you and, where required, the relevant government authorities, as soon as reasonably practicable and within any legally required timeframe. No security system is perfect. You are responsible for keeping your account credentials confidential. Contact us immediately at contact@zovian.com if you believe your account has been compromised.

Your Rights and Choices

Depending on where you live, you have certain rights over your personal data. We describe them below and explain how to exercise them. We respond to verified requests made under applicable state privacy law within 45 days and may extend this by an additional 45 days when reasonably necessary, with notice to you.

Rights Available to All Users

  • Marketing opt-out: unsubscribe from marketing emails by clicking the unsubscribe link in any such email or updating your notification settings in your account dashboard.
  • Cookie preferences: manage non-essential cookies through your browser settings.
  • Account deletion: delete your account through your account settings or by contacting us. Deletion of your account may result in forfeiture of unredeemed wallet balances as described in the Terms of Use.

Rights for US Residents

Your rights depend on where you live. If you live in a US state with a comprehensive privacy law, such as California, Colorado, Connecticut, Oregon, Texas, or Virginia, we honor the rights below where your state’s law provides them and applies to us. Not every right exists in every state. You may have the right to:

  • know and access the personal data we hold about you, including the categories, sources, and purposes of the data and the categories of third parties we disclose it to;
  • correct inaccurate personal data;
  • delete your personal data, subject to the exceptions the law allows (for example, completing a transaction you requested, security and fraud prevention, legal compliance, and legal claims);
  • receive your data in a portable format;
  • obtain a list of the specific third parties to which we have disclosed your personal data, if you live in Oregon or Minnesota;
  • opt out of the sale of your personal data, targeted advertising, and profiling in furtherance of decisions that produce legal or similarly significant effects;
  • appeal our decision if we decline to act on your request; and
  • be free from discrimination for exercising any of these rights.

Zovian does not sell personal data, share it for cross-context behavioral advertising, or use it for targeted advertising, as those terms are defined by applicable state privacy laws.

We collect and use sensitive personal data, such as government identification numbers, tax information, or biometric data used in an identity check, only where it is strictly necessary to provide a service you request, such as a cash-out, or to comply with the law. We never sell sensitive personal data.

To exercise any of these rights, email contact@zovian.com. For requests to access, correct, delete, or port your data, we will verify your identity, usually by confirming information already associated with your account. Opt-out requests do not require identity verification.

Where your state’s law allows, you may use an authorized agent to make a request on your behalf, with proof of the agent’s authority. Contact us at contact@zovian.com for instructions.

If we decline to act on your request, we will explain why. You may appeal by replying to our decision or by emailing contact@zovian.com with “Privacy Appeal” in the subject line. We will respond to your appeal in writing within 45 days. If we deny your appeal, you may contact your state’s attorney general.

California residents also have the right to know the specific pieces of personal data we hold about them. We do not disclose personal information to third parties for their own direct marketing purposes, as described in California’s “Shine the Light” law. Because we use sensitive personal information only for purposes the California law permits, the right to limit its use does not apply.

Children’s Privacy

The Platform is not directed at children under 13. We do not knowingly collect personal data from children under 13. If we learn that we have collected data from a child under 13, we will delete it promptly.

Only users who have reached the age of majority in their state of residence may create an account. If we learn that an account belongs to a minor, we will close it and delete the associated personal data, except where the law requires us to keep it. Teens may join the waitlist (13 and older in the US, 16 and older elsewhere), as described in “Waitlist and Tester Applications.”

Do Not Track/Global Privacy Controls

We do not respond to browser-based Do Not Track (DNT) signals because there is not yet an industry-standard approach to them. We do honor Global Privacy Control (GPC) and other recognized universal opt-out preference signals. We treat such a signal as a valid request to opt out of the sale or sharing of your personal data and of targeted advertising. We apply it to the browser or device that sends it, and to your account if you are signed in, without asking you to verify your identity or where you live. Because we do not sell or share personal data or use it for targeted advertising, honoring the signal does not change how the Platform works for you.

Changes to This Policy

We may update this Privacy Policy from time to time. When we make a material change, we will:

  • post the updated Policy on the Platform with a new “Last Modified” date;
  • notify you by email to the address on your account, or by an in-Platform notice; and
  • where required by law, seek your consent before the change takes effect.

Your continued use of the Platform after the effective date of an update constitutes acceptance of the revised Policy. If you disagree with any change, you may close your account by contacting us at contact@zovian.com.

Dispute Resolution

If you have questions or concerns about this Policy or how we handle your data, contact us first at contact@zovian.com. We will do our best to resolve the issue promptly.

Disputes relating to this Policy are also subject to the dispute resolution provisions of our Terms of Use (including informal resolution and binding arbitration), which are incorporated here by reference.
